Supreme Court Partially Right on Michigan Racial Preferences Case

Statement of Peter J. Thomas, Chairman of The Conservative Caucus

“The court has decided correctly in regard to Michigan’s constitutional guarantee of racial equality, but has failed to provide a coherent and enduring interpretation of the U.S. Constitution concerning racial preferences.

If a majority had joined in the opinion of Justice Scalia, the matter would be settled.  Instead, there will be continuing litigation over attempts to provide racial preferences, and the Supreme Court will not be able to dodge the issue forever.  We can only hope that its final decision, however delayed, will be similar to that supported by Justices Scalia and Thomas.”
